This Monday, on July 28th, the Supreme Court has decided to uphold the decision made by the Maharashtra Housing and Area Development Authority (MHADA) to redevelop Mumbai’s Motilal Nagar using the model presented by the Construction and Development Agency (C&DA). They have dismissed the legal challenges filed by the local resident’s association.
The Supreme Court’s bench that consisted of Justice Vikram Nath and Justice Sandeep Mehta has dismissed the special leave petition filed by – Motilal Nagar Jankalyankari Samiti, Motilal Rahivasi Vikas Sangh, and Gaurav Arun Rane. The petition was filed against the decision made by the Bombay High Court back in March 2025 which was in favour of a holistic redevelopment of 143 acres of Motilal Nagar I, II and III via C&DA.
Tushar Mehta, the Solicitor General of India, was arguing in favour of MHADA. It was reported that he had pointed out that the project was given a ‘special status’ by the Government of Maharashtra while the land was owned by the housing authority. On the other hand, senior counsel Siddharth Bhatnagar was representing the petitioners who filed a special leave petition.
According to the reports, the bench consisting of Justice Nath and Justice Mehta also stated that the decision made by the state government to give 1,600 sq feet built up area in lieu of about 230 sq feet was fair. The government gave an area that was way higher than the existing entitlement as per 33 (5) of Development Control and Promotion Regulations (DCPR) 2034.
This Friday, the Bombay High Court which consisted of a division bench of Chief Justice Alok Aradhe and Justice Bharti Dangre had rejected the review petition by Motilal Nagar Vikas Samiti. The court decided to uphold the redevelopment of Motilal Nagar in Goregaon West, Mumbai via C&DA route.
