In a landmark judgment more than a decade after the alleged crime, the Bombay High Court on Thursday sentenced former Tehelka editor-in-chief Tarun Tejpal to 10 years of rigorous imprisonment after convicting him in the 2013 rape case involving a former junior colleague. The court overturned a Goa trial court’s 2021 acquittal, marking a significant turn in one of India’s most closely watched sexual assault cases.
The case dates back to November 2013, when the complainant alleged that Tejpal sexually assaulted her inside a hotel elevator during an event in Goa. The allegations triggered widespread public debate and led to Tejpal’s resignation from Tehelka. He was arrested shortly afterwards, but a sessions court in Goa acquitted him in 2021, prompting the Goa government to challenge the verdict before the High Court.
While reversing the acquittal, the High Court strongly criticised the trial court’s reasoning, describing its findings as “perverse” and rejecting the notion that a survivor’s credibility should be judged against preconceived ideas of how an “ideal victim” ought to behave. The court observed that trauma manifests differently in every individual and that stereotypical expectations cannot determine the credibility of a sexual assault survivor.
During the sentencing proceedings, Tejpal maintained his innocence and indicated that he would continue pursuing legal remedies. His defence argued against a lengthy prison term, while the prosecution sought strict punishment, citing the abuse of authority and breach of trust involved in the case.
The verdict concludes a legal battle spanning nearly 13 years and is expected to be viewed as an important precedent in the judicial treatment of sexual assault cases, particularly in assessing survivor testimony without reliance on outdated stereotypes.
