Allahabad High Court orders case against Rahul Gandhi over dual citizenship

The Lucknow Bench of the Allahabad High Court has ordered the registration of a First Information Report (FIR) against Congress leader and Leader of Opposition in Lok Sabha Rahul Gandhi over allegations of dual citizenship, according to BJP leader Vignesh Shishir.

Shishir, a BJP worker from Karnataka, had moved the High Court earlier this year after a trial court in Lucknow refused to register an FIR against Gandhi in January 2026. That lower court had said it did not have the power to decide on questions of Indian citizenship.

In the fresh order, the Lucknow Bench directed the Kotwali Police Station in Rae Bareli district of Uttar Pradesh to register an FIR in what Shishir has called the “British citizenship case”. Shishir described the decision as a “landmark and historic judgement” and said it was in the interest of national security and public interest.

The case stems from Shishir’s claim that Rahul Gandhi may hold British citizenship, which, if proved, could raise questions about his eligibility to remain a Member of Parliament. The High Court has said the allegations “require investigation” and has asked the Uttar Pradesh government to either probe the matter or hand it to a central agency.

The matter is being watched closely ahead of the next general election, as it touches on both Gandhi’s political status and wider rules about citizenship and disqualification of MPs.
